These Terms of Use (“Terms”) govern your access to and use of the website operated by Community Health Centers, Inc. (“CHCFL,” “CHC,” “we,” “us,” or “our”), including the content, features, forms, and services made available through the website.

By accessing or using the website, you acknowledge that you have read and understood these Terms and agree to comply with them. If you do not agree with these Terms, please do not use the website.

1. Purpose of the Website

The CHCFL website provides general information about:

  • CHCFL healthcare services;

  • Health center locations;

  • Providers;

  • Office hours;

  • Accepted insurance plans;

  • Patient resources;

  • Appointment options;

  • Patient forms;

  • Prescription-refill services;

  • Bill-payment services;

  • Patient-portal access;

  • Employment opportunities;

  • Community programs;

  • Donations; and

  • Other CHCFL information and services.

Some services available through links on the website are operated through separate systems or by other organizations. Additional terms, notices, consents, or policies may apply when you use those services.

2. Medical Emergencies

The website, online forms, ordinary email, and general website contact features should not be used for medical emergencies.

Call 911 or go to the nearest emergency department if you are experiencing a medical emergency.

Do not use a general website form or email to report urgent symptoms, request urgent medical advice, or communicate information requiring an immediate response.

CHCFL does not guarantee that a message submitted through the website will be reviewed within any particular period.

3. No Medical Advice

Information on the public website is provided for general informational and educational purposes.

Website content is not intended to:

  • Diagnose a medical or dental condition;

  • Provide individualized medical, behavioral-health, dental, pharmacy, or other healthcare advice;

4. No Provider-Patient Relationship Created by Browsing

Accessing or browsing the public website does not, by itself, create a provider-patient relationship between you and CHCFL or any CHCFL provider.

A provider-patient relationship may be established only through an appropriate registration, appointment, examination, treatment, telehealth, or other healthcare process authorized by CHCFL.

Submitting an appointment request, contact form, or other online inquiry does not guarantee:

  • Acceptance as a patient;

  • Confirmation of an appointment;

  • Availability of a provider or service;

  • Insurance coverage;

  • Eligibility for a program;

  • A particular treatment or outcome; or

  • A response within a particular period.

An appointment is not confirmed until CHCFL or its authorized scheduling system provides confirmation.

5. Patient Services and Separate Requirements

Certain website links may connect you to systems used for:

  • Appointment scheduling;

  • Patient registration;

  • Patient forms;

  • The patient portal;

  • Prescription refills;

  • Bill payment;

  • Medical-record requests;

  • Telehealth;

  • Employment applications;

Nothing in these Terms replaces or modifies:

  • A patient consent or authorization;

  • A treatment agreement;

  • Financial-responsibility documents;

  • Sliding Discount Program requirements;

  • A Good Faith Estimate;

  • Patient rights and responsibilities;

  • A telehealth consent;

  • An employment application agreement;

  • Any rights or obligations established by applicable healthcare law; or

  • Any other document specifically governing healthcare or another CHCFL service.

6. Use by Minors and Authorized Representatives

CHCFL provides services to both children and adults.

A parent, legal guardian, caregiver, personal representative, or other authorized person may use appropriate website features on behalf of another individual when permitted by law.

If you are not legally able to agree to these Terms independently, you should use the website only with the involvement and permission of a parent, legal guardian, or other authorized representative.

Certain healthcare services may be available to minors without parental or guardian involvement when permitted by law. These Terms are not intended to restrict any rights a minor may have under applicable healthcare or privacy law.

You may not falsely represent that you are authorized to act for another person.

7. Accurate Information

When you submit information through the website, you agree to provide information that is accurate and complete to the best of your knowledge.

You agree not to:

  • Impersonate another person;

  • Use another person’s information without authorization;

  • Submit false appointment, refill, payment, employment, or service requests;

  • Provide intentionally misleading information;

  • Attempt to gain unauthorized access to another person’s account or records; or

  • Use the website to commit fraud or another unlawful act.

You are responsible for reviewing information before submitting it.

Contact CHCFL promptly if you believe information submitted through the website was incorrect or submitted without authorization.

8. Account and Portal Security

Some services may require a username, password, verification code, or other authentication information.

You are responsible for:

  • Maintaining the confidentiality of your login credentials;

  • Using a secure device and network;

  • Signing out after using a shared or public device;

  • Not sharing authentication codes or passwords with unauthorized individuals; and

  • Promptly reporting suspected unauthorized access.

You may not attempt to access another person’s account, patient information, payment information, employment application, or other restricted information without lawful authorization.

The patient portal and other secure systems may be governed by additional security requirements and terms.

9. Permitted Use

CHCFL grants you a limited, nonexclusive, nontransferable, and revocable permission to access and use the public website for lawful personal, patient-care, informational, educational, employment, community, or business purposes consistent with the functions CHCFL makes available.

You may download or print patient forms, educational materials, location information, and other materials when the website makes those materials available for personal or authorized use.

No other rights are granted except as expressly stated in these Terms or required by law.

10. Prohibited Uses

You may not use the website to:

  • Violate any applicable law or regulation;

  • Interfere with the website’s operation or security;

  • Attempt to gain unauthorized access to any system, account, network, database, or information;

  • Introduce a virus, malicious code, ransomware, spyware, or other harmful material;

  • Circumvent an access restriction or security measure;

  • Conduct unauthorized vulnerability testing or penetration testing;

  • Collect personal information about another person without authorization;

  • Scrape or systematically extract website content in a manner that burdens the website or violates applicable law;

  • Use automated tools to submit appointments, forms, messages, applications, or other requests without authorization;

  • Impersonate CHCFL, a CHCFL provider, employee, patient, applicant, or another person;

  • Submit fraudulent, threatening, harassing, defamatory, discriminatory, obscene, or unlawful content;

  • Send spam, unsolicited advertising, or repetitive messages;

  • Infringe intellectual-property, privacy, publicity, or other rights;

  • Interfere with another person’s lawful use of the website;

  • Attempt to obtain medical, financial, employment, or other confidential information without authorization; or

  • Use the website for any purpose inconsistent with its intended healthcare, informational, employment, or community functions.

CHCFL may investigate suspected misuse and may restrict access, preserve relevant information, or report conduct to appropriate authorities as permitted by law.

Nothing in this section prohibits ordinary use by search engines, accessibility technologies, security researchers acting with written authorization, or other lawful activities.

11. Intellectual Property

Unless otherwise stated, website content—including text, graphics, photographs, videos, logos, designs, documents, icons, and software—is owned by or licensed to CHCFL and is protected by applicable intellectual-property laws.

You may access and use website content for personal, noncommercial, patient-care, educational, or other purposes for which CHCFL makes the content available.

You may not, without authorization:

  • Reproduce substantial portions of the website for commercial use;

  • Sell, license, or commercially exploit website content;

  • Remove copyright, trademark, or other ownership notices;

  • Misrepresent CHCFL content as your own;

  • Use CHCFL names or logos in a way that suggests an unauthorized endorsement or affiliation; or

  • Modify and redistribute website content in a misleading manner.

You may link to a public CHCFL webpage provided that the link is accurate, lawful, and does not falsely suggest sponsorship, endorsement, or affiliation.

12. Feedback and Communications

You may send CHCFL questions, corrections, suggestions, or other feedback about the website.

You retain ownership of any original material you submit. By voluntarily submitting nonconfidential feedback about the website, you authorize CHCFL to review and use that feedback to operate, correct, secure, or improve the website and its services.

CHCFL will not treat protected health information submitted through an authorized healthcare process as unrestricted feedback.

Do not submit copyrighted, confidential, or proprietary material belonging to another person unless you have permission to do so.

13. Privacy

Your use of the website is also subject to CHCFL’s Website Privacy and Cookie Policy, available through the website footer.

Protected health information maintained by CHCFL is governed by CHCFL’s Notice of Privacy Practices and applicable healthcare privacy laws.

These Terms do not authorize CHCFL or any website visitor to use or disclose protected health information in a manner inconsistent with applicable law.

Please review the privacy notice of any external website or service before providing information to it.

14. Third-Party Websites and Services

The website may include links to or embedded features from third parties, including providers of:

  • Patient portals;

  • Scheduling systems;

  • Electronic forms;

  • Prescription-refill services;

  • Payment processing;

  • Medical-record services;

A link does not necessarily mean that CHCFL owns, controls, endorses, or guarantees the external website or its services.

CHCFL is not responsible for the independent content, availability, security, or privacy practices of a third-party website, except to the extent responsibility cannot lawfully be excluded.

You should confirm time-sensitive or important information directly with CHCFL before relying on it.

CHCFL may correct, update, remove, suspend, or discontinue website content or features when reasonably necessary.

CHCFL DOES NOT WARRANT THAT:

  • THE WEBSITE WILL ALWAYS BE AVAILABLE;

  • WEBSITE CONTENT WILL BE FREE FROM EVERY ERROR OR OMISSION;

  • EVERY FEATURE WILL OPERATE ON EVERY DEVICE OR BROWSER;

IT DOES NOT ALTER CHCFL’S RESPONSIBILITIES UNDER HIPAA, OTHER HEALTHCARE LAWS, CHCFL’S NOTICE OF PRIVACY PRACTICES, AN APPLICABLE PATIENT AGREEMENT, OR ANY LAW GOVERNING THE PROVISION OF HEALTHCARE.

17. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CHCFL AND ITS DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING SOLELY FROM USE OF, OR INABILITY TO USE, THE PUBLIC WEBSITE.

THIS MAY INCLUDE LOSS CAUSED BY:

  • WEBSITE INTERRUPTION;

  • DEVICE OR SOFTWARE INCOMPATIBILITY;

  • RELIANCE ON GENERAL WEBSITE INFORMATION;

  • LOSS OF DATA;

  • MALICIOUS SOFTWARE INTRODUCED BY A THIRD PARTY; OR

  • AN EXTERNAL WEBSITE OR SERVICE NOT CONTROLLED BY CHCFL.

THIS LIMITATION DOES NOT APPLY TO:

  • LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW;

  • CHCFL’S OBLIGATIONS CONCERNING PROTECTED HEALTH INFORMATION;

  • RIGHTS OR REMEDIES ARISING FROM THE PROVISION OF HEALTHCARE;

  • GROSS NEGLIGENCE OR WILLFUL MISCONDUCT TO THE EXTENT IT CANNOT BE DISCLAIMED;

  • PERSONAL INJURY CAUSED BY CONDUCT FOR WHICH LIABILITY CANNOT LAWFULLY BE LIMITED; OR

  • ANY OTHER CLAIM FOR WHICH A LIMITATION IS PROHIBITED BY LAW.

Nothing in these Terms is intended to expand or restrict any protection, remedy, procedure, or requirement that applies to CHCFL or its covered individuals under the Federal Tort Claims Act or other applicable law.

18. Responsibility for Misuse

To the extent permitted by law, you are responsible for losses or claims resulting from your intentional unlawful misuse of the website, your unauthorized access to another person’s account or information, or your infringement of another person’s rights.

This responsibility does not apply to losses caused by CHCFL’s own conduct or to the extent otherwise prohibited by law.

CHCFL reserves the right to control the defense of a claim arising from unlawful website misuse and will provide reasonable notice when appropriate.

19. Restriction or Termination of Access

CHCFL may restrict or terminate access to all or part of the website when reasonably necessary to:

  • Protect website or network security;

  • Investigate suspected fraud or misuse;

  • Comply with law or a legal request;

  • Protect patients, employees, or other users;

  • Prevent disruption of website services; or

  • Address a material violation of these Terms.

Where reasonable, restrictions will be limited to the affected feature, account, device, or user.

Termination of website access does not alter rights or obligations concerning healthcare records, patient care, payment, privacy, or other matters governed by separate law or agreements.

20. Electronic Communications

When you voluntarily submit an online form, request, or application, you authorize CHCFL or its applicable service provider to respond using the contact information you provide.

You are responsible for providing accurate contact information and for considering whether email, text messaging, or telephone communication is appropriate for your privacy needs.

Submitting a form does not constitute consent to receive unrelated marketing communications unless the form clearly requests and documents that consent.

An electronic signature will have legal effect only when:

  • The applicable form or system identifies it as an electronic-signature process;

  • The individual intends to sign;

  • The individual is authorized to sign; and

  • Applicable legal requirements are satisfied.

Nothing in these Terms requires you to waive a right to receive a paper document when applicable law provides that right.

21. Copyright Concerns

A person who believes material on the website infringes a copyright may contact CHCFL and provide:

  • Identification of the copyrighted work;

  • Identification and location of the allegedly infringing material;

  • The complaining person’s contact information;

  • A statement describing the basis of the complaint; and

  • Any other information reasonably needed to evaluate the concern.

Copyright concerns may be sent to the contact information in Section 26.

CHCFL may remove or restrict access to material while reviewing a legitimate infringement claim.

22. Accessibility

CHCFL seeks to make its website accessible to individuals with disabilities.

A person who experiences difficulty accessing website information or functionality may contact CHCFL to request assistance or report an accessibility issue.

Please identify:

  • The webpage or feature involved;

  • The nature of the difficulty;

  • The assistive technology or browser used, when relevant; and

  • A preferred method of contact.

23. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where federal law applies or applicable law requires otherwise.

Nothing in these Terms changes the law that applies to:

  • Healthcare services;

  • Protected health information;

  • Employment;

  • Civil rights;

  • Consumer rights;

  • Federal healthcare programs;

  • The Federal Tort Claims Act; or

  • Any claim that cannot lawfully be governed by a contractual choice-of-law provision.

24. Venue and Disputes

Before filing a dispute concerning the public website, you are encouraged to contact CHCFL so the concern can be reviewed and, when possible, resolved.

Unless applicable law requires otherwise, a legal proceeding arising exclusively from use of the public website may be brought in a state or federal court with appropriate jurisdiction in Orange County, Florida.

These Terms do not require arbitration and do not waive any right to a jury trial, class proceeding, administrative complaint, regulatory complaint, or other process available under applicable law.

This section does not govern a healthcare malpractice claim, privacy complaint, employment dispute, billing appeal, insurance appeal, patient grievance, civil-rights complaint, or another matter subject to a separate legal process.

25. General Provisions

If any provision of these Terms is found unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted or severed if necessary. The remaining provisions will continue in effect.

CHCFL’s failure to enforce a provision on one occasion does not waive the right to enforce it later.

Headings are provided for convenience and do not control interpretation.

These Terms, together with policies or notices specifically incorporated into them, constitute the terms governing use of the public website. Separate agreements may govern healthcare, employment, payment, donation, portal, scheduling, or other services.

Nothing in these Terms creates a partnership, joint venture, employment relationship, agency relationship, or fiduciary relationship between a website visitor and CHCFL.

CHCFL may update these Terms to reflect changes in the website, services, technology, security practices, or applicable law.

Updated Terms will be posted with a revised effective date. Continued use of the website after the effective date of an update constitutes acceptance of the revised Terms to the extent permitted by law.
